nangungulila….

November 9, 2011

daddy, i love you so much. i will always miss you. see you in heaven

2011 Bar Permits Now Available for Pickup

October 8, 2011

The Office of the Bar Confidant (OBC) today announced that 2011 Bar examination permits with Bar examinee numbers “1” up to “5000” are now ready for pickup at the OBC, SC–CA Multi-Purpose Building, Padre Faura, Ermita, Manila.

Deputy Clerk of Court and Bar Confidant Atty. Ma. Cristina B. Layusa also announced that applicants with Bar examinee numbers above “5000” are advised to call the OBC first at telephone numbers 5268122 and 5257929 to confirm if their respective permits are available for pickup.

Justice Roberto A. Abad is the Chairperson of the 2011 Committee on Bar Examinations. This year’s Bar examinations will be conducted in all four Sundays of November as follows: First day: Political and International Law, and Labor and Social Legislation (morning) and Taxation (afternoon); Second day: Civil Law (morning) and Mercantile Law (afternoon); Third day: Remedial Law, and Legal Ethics and Forms (morning) and Criminal Law (afternoon); Fourth day: Trial Memorandum (morning) and Legal Opinion (afternoon).

The Supreme Court has recently approved substantial changes in the conduct of the Bar Examinations, including the moving the schedule of the exams from September to November 2011.

The coverage of the Bar Examinations shall now be drawn up by topics and sub-topics rather than by simply stating the covered laws.

Another change is the use of multiple-choice questions that are to be so constructed as to specifically measure the candidate’s knowledge of and ability to recall the laws, doctrines, and principles that every new lawyers needs in his practice, and assess the candidate’s understanding of the meaning and significance of those same laws and principles as they apply to specific situations.

The Examinations shall also include essay-type questions which will not be Bar-subject specific. One such essay examination will require the candidate to prepare a trial memorandum or a decision based on a documented legal dispute. This essay will account for 60 percent of the exam’s essay portion. The remaining 40 percent will be covered by an essay which will require the Bar candidate to prepare a written opinion sought by a client concerning a potential legal dispute facing him or her.

In computing a candidate’s final grade in the Bar Examinations, the results of the multiple-choice questions examinations will be given a weight of 60 percent, while those of the essay-type examinations will be given a weight of 40 percent.

Since this is the first time that that the new format will be implemented, the answers of all candidates in the essay-type examinations will be corrected irrespective of the results of their multiple-choice questions examinations, which are known earlier because these will be checked electronically. In future Bar Examinations, however, the Bar Chairperson shall recommend to the Court the disqualification of those whose grades in the multiple-choice questions are so low that it would serve no useful purpose to correct their answers in the essay-type examinations.

On Payment of Prescribed Filing Fees…..

September 9, 2011

“The Non-Payment of prescribed filing fees at the time of the filing of the complaint or another initiatory pleading fails to vest jurisdiction over the case in the trial court. Yet, where the plaintiff has paid the amount of filing fees assessed by the clerk of court, and the amount paid turns out to be deficient, the trial court still acquires jurisdiction over the case, subject to the payment by the plaintiff of the deficiency assessment.”

An end to voluminous court documents?

September 1, 2011

In an effort to reduce the judicial and legal systems’ impact on the environment, and make better use of scarce court time, the Supreme Court’s subcommittee on the revision of rules of civil procedure approved the Rule for the Efficient Use of Paper and Court Time (Proposed Rule).

The Proposed Rule, which is part of the reform agenda of the Corona Court, will apply to all courts and quasi-judicial bodies.

Efficient use of paper

The report of the subcommittee notes that about 20 trees are cut and 100,000 liters of water, which cannot be reused as it is laden with chemicals, are used per 500 reams of paper.

To achieve the goal of helping save the environment, the Proposed Rule limits the number of pages and copies as well as imposes the format, style and margins for all court-bound papers.

Each court-bound paper should be written on a 13-inch by 8.5-inch white bond paper, in single space, font size 13 or 14, in a font style of the parties’ choice with all its pages numbered. The margin to be maintained by the parties should be a left hand margin of 1.5 inches from the edge, an upper margin of 1.2 inches from the edge, a right hand margin of 1 inch from the edge, and a lower margin of 1 inch from the edge.

If the parties use a paper of sufficient thickness, they have the option of using both sides of the paper, this time observing a margin of 1.5 inches from the edge of both left and right sides. Failure to comply with any of these would merit a carbon penalty of P1,000.

In addition, from the seven and 18 copies of court-bound papers that are currently filed with the Court of Appeals and the Supreme Court, respectively, the number will be reduced to one original and two copies in the Court of Appeals, the Sandiganbayan and the Court of Tax Appeals, and one original and four copies in the Supreme Court. In other courts and quasi-judicial agencies, only one original will be required.

Annexes will be required to be attached only to the original and one copy in each case. Also, a party will no longer be required to attach all annexes when serving a copy to adverse parties when it can be presumed from the circumstances that such party already has them.

Efficient use of court time

To save on both paper and court time, the Proposed Rule also sets a limit of 20 pages, including the signature page, for each court-bound paper. The parties may add up to 10 pages of end notes containing citations and authorities.

Compliance with these page restrictions is enforced by way of a carbon penalty and court time charge in the combined amount of P10,000 for every page that exceeds the limits in the Supreme Court; P5,000 in the Court of Appeals, the Sandiganbayan, and the Court of Tax Appeals; and P3,000 in the various trial courts and quasi-judicial bodies.

Any court-bound paper submitted without the payment of penalty and charges will be deemed not filed and will be stricken off the record.

Conclusion

The objectives of the Proposed Rule are laudable. Lawyers these days, on account perhaps of the ease with which research is done through the Internet, have become more verbose in their court submissions than their predecessors. As a result, our courts have virtually become warehouses for tons of documents and one has only to walk though court corridors to realize that they have also become fire hazards.

The Proposed Rule will force lawyers to analyze voluminous materials and distinguish the “essential” from the “non-essential,” instead of merely quoting an amalgamation of cases and doctrines and dumping them on the lap of the court. In the words of the subcommittee, “lawyers should learn how to make their pleadings and papers terse and direct and pruning them of irrelevant and often repetitious statements of facts, issues and arguments.”

Hopefully, we will soon see the end of voluminous court papers and, in the process, the judicial system and legal profession will help “cut the use of excessive quantities of costly paper, save our forest and mitigate the worsening climate changes that the world is experiencing.”

The Proposed Rule is just one of the many steps that the court has taken to help save Mother Earth. Apart from the Rules on Kalikasan, which are now in place, our e-commerce subcommittee has drafted a proposed rule on electronic filing, which is envisioned to do away with paper filings in our courts. We are also working on the rules on electronic notarization.  There are issues—both technical and operational—that have to be resolved before e-filing and e-notarization can be adopted as part of our court system. In the meantime, the Proposed Rule is a step toward the right direction.

isang linggo na ngayon……

August 16, 2011

Bar Fee Increased

July 22, 2011

The Supreme Court has approved the PhP250 increase from PhP2,750 to PhP3,000 of the Bar Examination and admission fees effective this examination year. This is to meet the increase in cost of materials and personnel requirements of the Bar Examinations according to Atty. Ma. Cristina B. Layusa, Deputy Clerk of Court and Chief of the Office of the Bar Confidant, through which the Supreme Court administers the said Exams.

The 2011 Bar Examinations will be held at the Royal and Pontifical University of Santo Tomas. Previously, the Supreme Court had approved substantial changes in the conduct of the 2011 Bar Examinations, including the moving the schedule of the Exams from September to November 2011.

This essay will account for 60 percent of the Examinations’ essay portion.

2011 Bar Committee Chair Justice Roberto A. Abad has conducted a series of seminars nationwide to orient law deans, professors, and students of the aforesaid changes. (B.M. No. 850, In re: Request to Increase the Bar Examinations and Admission Fees, June 21, 2011)

NBI sees delays in clearance release after contractor’s pullout
By Sandy Araneta The Philippine Star Updated July 02, 2011 12:00 AM

Manila, Philippines - There may be delays in the processing and issuance of clearances by the National Bureau of Investigation after Mega Data Corp., the company that ran the NBI’s computerized clearance processing system for the past 30 years, pulled out its software and hardware systems after its contract expired Thursday.

The NBI suspended accepting applications for clearances yesterday and said it will resume on July 4.

Supervising Agent Gerry Perdido, who is with the NBI’s technical services unit, said the bureau will definitely undergo a “downtime” in the processing and release of clearances, “but we are doing everything to address this concern. He said the NBI releases about 22,000 clearances daily nationwide.

Perdido said they will use their staff to shorten the delay, but noted that they will not revert to the manual system.

He said the Department of Justice (DOJ)  Separate Bids and Awards Committee (SBAC), in charge of the bidding for the NBI Citizens Database Information System, has not yet come up with the terms of reference (TOR) required  for the bidding.

He cited a failure in the bidding when the project was bid out in October 2009. NBI Director Magtanggol Gatdula earlier said five firms joined the bidding – V.G. Roxas and Co., Inc., Mega Data Corp., Total Information Management, Systems and Plan Integrator and Development Corp. (SPIDC) and Data Trail Corp. – but the NBI’s bidding and awards committee issued a resolution on Sept. 27, 2010 declaring a failure of bidding.

Only two firms, Mega and SPIDC, were left. Both firms alleged that the TOR had been “tailored” to favor the other firm, and the perceived bias on the part of the NBI bid body and the technical working group that drew up the TOR.

Despite Mega Data’s pullout, Gatdula guaranteed the continuity of the NBI’s clearance service and vowed that all transactions related to the procurement of a new system will be aboveboard and transparent.

renewal ng appointment

June 16, 2011

so help me GOD!

SC Approves Changes in Conduct of Bar Exams

May 6, 2011

The Supreme Court recently approved substantial changes in the conduct of the Bar Examinations, including the moving the schedule of the exams from September to November 2011.

In line with these changes, the Court also approved the new schedule of the filing of Petitions to Take the Bar Examinations to July 1, 2011 up to August 15, 2011.

The venue of the 2011 Bar Examinations will be the University of Santo Tomas in Manila. (BM No. 2265, Re: Reforms in the 2011 Bar Examinations, January 18, 2011 and BM No. 1161, Re: Proposed Reforms in the Bar Examinations, February 1, 2011)

very nice blog. nag-enjoy akong basahin lalo na ang adventures mo sa pag-aaply sa PAO. keep it up.

Carmen Martin:

Hi! nakakatuwa naman ang blog mo na to panyera. especially the neuro exam. at least you gave me an idea kung panu ang mangyayari sa neuro exam. I passed an application kasi sa PAO last Oct. 28, 2011. bago pa lang.
